TERMS AND CONDITIONS

  1. Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions. Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

  2. Entry is open only to permanent Australian residents aged 18 years or older. Directors, management and employees of the Promoter and associated companies and agencies as well as the immediate families of each of these people are not eligible to enter.

  3. The promotion begins on 12:00am AEST on 6th July 2026 and closes 11:59pm AEST on 30th August 2026 (Promotional Period).

  4. To enter, during the Promotion Period, entrants must:
    a. Fully complete the entry form found at www.nicorette.com.au/quitaroos and
    b. As part of the entry form, submit an original response of 50 words or less explaining your number one reason for quitting smoking.
    c. Entrants must be a member of the Nicorette Instagram broadcast channel at the time of judging.

  5. Entries must be received by the Promoter during the Promotion Period. Each entrant may only enter once.

  6. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.

  7. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.

  8. Each entrant is responsible for the entry they submit and responsible for paying for the costs associated with entering the promotion.

  9. The Promoter’s judging panel will review all valid entries received during the Promotion Period. On the week commencing Monday 31st August 2026, the judging panel will judge all entries based on the following criteria:
    • Creativity and originality; and
    • Entrants must be a member of the Nicorette Instagram broadcast channel at the time of judging.

  10. This is a game of skill and chance plays no part in determining the winners. The entry judged to be the best overall will receive the first prize. The next 70 highest-ranked entries will each receive a runner-up prize. with the total number of runner-up prizes capped at 70 Quit Support Kits. See paragraph 17 below for prize details.

  11. Entries that are found to have been derived from third party work will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter. Without limiting the generality of other conditions, the Promoter reserves the right to take legal action against anyone found to have breached this condition. The Promoter reserves the right in its sole discretion to (i) not consider any entry which is not in accordance with these conditions of entry; and (ii) to disqualify any individual who the Promoter has reason to believe has breached any of these conditions of entry or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages and other compensation are reserved.

  12. Each entrant warrants and agrees that:
    a. the entrant has created the entry themself;
    b. the entrant is entitled to reproduce and exploit all of the underlying works in the entry;
    c. the entrant will not submit material in their entry that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless the entrant is the owner of such rights;
    d. the entry has not been previously published in any other medium or forum worldwide;
    e. they will not submit material that is unlawful, obscene, defamatory, derogatory, threatening, pornographic, sexually inappropriate, violent, abusive, harassing, hateful, racially, religiously or ethnically offensive, or encourages, evidences or indicates conduct that would be considered a criminal offence, gives rise to civil liability, or violates any law;
    f. the entry will not contain viruses or cause injury or harm to any person or entity; and
    g. the entrant has not granted rights to their entry to any other person which is inconsistent with the rights granted to the Promoter.

  13. Each entrant consents to the Promoter (and each of its assignees and licensees) doing or omitting to do anything which may infringe any and all moral rights of the entrant including to edit, alter and reproduce the entry, and that such consents have been obtained to the full extent permitted under the Copyright Act 1968 (Cth).

  14. As a condition of accepting the prize, each winner agrees to:
    a. if required by the Promoter, sign a statutory declaration regarding the  originality of their entry; and
    b. irrevocably and unconditionally assign to the Promoter all of his/her right, title and interest (including without limitation all intellectual property rights such as present and future copyright) in and to the winning entry and to sign a document (in a form to be determined by the Promoter) to acknowledge this assignment to the Promoter.

  15. Each entrant acknowledges and agrees that if their entry wins, the Promoter (any each of its assignees and licensees) have the right, in their absolute discretion, to edit, amend, copy, use, publish, broadcast and communicate to the public, the entry in any media including the internet, without any further consultation, reference, payment or any other compensation to the entrant.

  16. Each entrant must create their own entry and only submit an entry in their own name. All entries become the property of the Promoter.

  17. The winning entrant will win a prize of a digital VISA prepaid card to the value of $5,000 AUD. The 70 runners up will each win a prize of Nicorette Quitaroos Quit Support Kit each valued at $143.07 AUD. The total number of Quit
    Support Kits awarded is capped at 70. The Quit Support Kits include:

  18. The total prize pool is valued at $15,014.90 AUD. All prize values are the recommended retail value (including GST) in Australia as provided by the supplier and are correct at the time of printing.

  19. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

  20. Once any prize has left the Promoter’s premises, the Promoter and its agencies and companies associated with the promotion will not be responsible for any delay in delivery, loss or damage to the prize.

  21. Prize winners will be notified by email within ten (10) business days of judging Each winner is responsible for ensuring that the email address or postal address (as it applies) provided is correct. Each winner’s name and State or Territory of residence will be published at www.nicorette.com.au/quitaroos

  22. The Promoter may require a winner to verify their entry and provide proof of identity, proof of age, proof of residency at the nominated prize delivery address. Proof considered suitable for verification is at the Promoter’s discretion.

  23. Prizes will be mailed by the Promoter directly to the winner to the address provided on their entry form within 28 days of the judging of the winner.

  24. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded. The judges’ decision is final and no correspondence will be entered into.

  25. The Promoter may verify the validity of entries, and in its sole discretion, disqualify all entries from, and prohibit further participation in this promotion by, any person who manipulates or tampers with or benefits from any manipulation of or tampering with the entry process or the operation of the promotion (including, but not limited to soliciting votes, disguising an IP address, using multiple email addresses or aliases to submit multiple entries for the same person, or other electronic account) or acts in violation of these conditions, acts in a dishonest or disruptive manner , acts with the intent to annoy, abuse, threaten or harass any other person, or acts in a way to jeopardise the fair operation of the promotion.. The Promoter’s decision in relation to all aspects of the promotion is final and no correspondence will be entered into.

  26. Prizes are not transferable or exchangeable and cannot be redeemed for cash. In the event for any reason a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.

  27. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, manipulation, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries.

  28. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

  29. In the event of a prize not being accepted or claimed, the judges will select an alternate winner with the entry judged to be the next best entry to receive that prize.

  30. Entrants’ personal information (PI) will be collected to enable the Promoter and its agencies to administer and promote this promotion (and its winners), and to contact entrants in connection with this promotion. Where an entrant has opted in, their PI may also be used by the Promoter for marketing and promotional purposes in accordance with the entrant’s preferences. The PI of winners may be provided to third parties assisting in the conduct of the promotion, including prize suppliers and deliverers, and for publicity purposes surrounding the promotion. The Promoter may disclose personal information to recipients located outside Australia, including in the United States. Overseas recipients may be subject to privacy laws that differ from those in Australia. If the PI requested is not provided, the entrant may not participate in the promotion. Personal information will be retained for as long as reasonably necessary to administer the promotion and to comply with legal and regulatory obligations, after which it will be securely destroyed or de-identified. The Promotion starts in each Participating Venue on the start date specified on in-venue promotional advertising, which shall be no earlier than the Start Date. The Promotion ends in each Participating Venue on the end date specified on in-venue promotional advertising, which shall be no later than the End Date.

Eligible Entrants

Entry is open only to residents of New South Wales, Victoria or Queensland who are 18 years of age or older at the time of entry.

Participating Venues

The Promotion will be conducted at various sampling locations throughout the metropolitan areas of Sydney (New South Wales), Melbourne (Victoria) and Brisbane (Queensland) during the Promotion Period on a mobile sampling basis (each, a “Participating Venue” and together the “Participating Venues”). Participating Venue locations will be determined by the Promoter from time to time during the Promotion Period and will be operated by the Promoter’s brand ambassador team. Participating Venues may be subject to change at the Promoter’s discretion.

How to Enter

To enter the Promotion, the entrant must, during the Promotion Period:
(a) obtain a promotional scratch card (“Scratch Card”) from the Promoter’s brand ambassador team at a Participating Venue, while stocks last; and
(b) scratch the panel on the Scratch Card to reveal whether or not they have won a prize.
Scratch Cards will be distributed by the Promoter’s brand ambassador team at Participating Venues during the Promotion Period, while stocks last. No purchase is necessary to obtain a Scratch Card. No entry fee is charged.

Entries Permitted

Multiple entries are permitted subject to the following limits:
(a) maximum of one (1) Scratch Card per person per day;
(b) one (1) entry per Scratch Card.
Each Scratch Card constitutes a single entry. Entrants must obtain their own Scratch Card in person from a brand ambassador; Scratch Cards cannot be collected on behalf of another person.

Winner Determination

Mechanism: Instant win.
Number of Scratch Cards: 2,044 Scratch Cards in total will be distributed during the Promotion.
Number of winning Scratch Cards: All 2,044 Scratch Cards are winning Scratch Cards (comprising 1,444 Prize 1 cards, 100 Prize 2 cards, and 500 Prize 3 cards). Every Scratch Card distributed during the Promotion will reveal a prize.
Prize redemption: Winners must surrender their winning Scratch Card to the Promoter’s brand ambassador immediately upon scratching the Scratch Card and revealing a winning prize. Any winning Scratch Card not surrendered at the moment of scratching will be void and the prize forfeited. The Promoter is not required to honour any winning Scratch Card presented after the entrant has left the Participating Venue. The Promoter’s brand ambassador will award the corresponding prize to the winner on the spot, while prize stocks last. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Conditions of Entry, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials are void if stolen, forged, mutilated or tampered with in any way.

2. Conditions of Entry

  1. Entry is open only to residents of New South Wales, Victoria or Queensland who are 18 years of age or older at the time of entry. Directors, management and employees of the Promoter, its parent companies (including Kenvue Inc.), subsidiaries and related bodies corporate (within the meaning of the Corporations Act 2001 (Cth)), and any agencies, prize suppliers and other businesses directly associated with the conduct of this Promotion, as well as the immediate families of each of these people, are not eligible to enter. “Immediate family member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

  2. The Promotion commences on the Start Date and ends on the End Date specified in the Schedule (“Promotion Period”). Entries are deemed to be received at the time of receipt by the Promoter’s brand ambassador and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.

  3. Valid and eligible entries will only be accepted during the Promotion Period.

  4. Winning Scratch Cards must be surrendered to the Promoter’s brand ambassador immediately upon scratching the Scratch Card and revealing a winning prize. Any winning Scratch Card not surrendered at the moment of scratching will be void and the prize forfeited. The Promoter is not required to honour any winning Scratch Card presented after the entrant has left the Participating Venue. The Promoter’s brand ambassador team will inform entrants of this requirement before each Scratch Card is provided.

  5. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize within the time specified by the Promoter, they will forfeit the prize and the Promoter is not obliged to offer a substitute prize.

  6. No part of a prize is exchangeable, redeemable for cash or any other prize, or transferable, unless otherwise specified in writing by the Promoter.

  7. If a prize (or portion of a prize) is unavailable, the Promoter reserves the right to substitute the prize (or that portion of the prize) for a prize of equal or greater value and specification, subject to any written directions of a regulatory authority.

  8. No entry fee is charged by the Promoter to enter the Promotion. Each entrant is responsible for paying for any costs associated with travelling to a Participating Venue.

  9. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and the entrant’s details (including the entrant’s identity, age and place of residence). Identification considered suitable for verification is at the Promoter’s discretion. In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. The Promoter may in its sole discretion, disqualify all entries from, and prohibit further participation in this promotion by, any person who manipulates or tampers with or benefits from any manipulation of or tampering with the entry process or the operation of the promotion.

  10. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.

  11. Prize 1 – Nicorette therapeutic goods. The Nicorette nicotine lozenges and gum awarded as Prize 1 are therapeutic goods. Winners should always read the label and use only as directed. Nicorette products are intended for use by adult smokers seeking to quit smoking. The Promoter makes no health claims in connection with this Promotion.

  12. Prize 2 – $10.00 Visa Gift Card. Any ancillary costs associated with redeeming the gift card are not included. Any unused balance of the gift card will not be awarded as cash. Redemption of the gift card is subject to any terms and conditions of the issuer including those specified on the gift card.

  13. If a prize is provided to the Promoter by a third party, the prize may be subject to additional terms and conditions of the third party prize supplier, which the winner agrees to comply with. Nothing in these Conditions of Entry or any third party terms limits any rights that an entrant or winner has under the Australian Consumer Law or other non-excludable statutory rights. To the extent permitted by law, the Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.

  14. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

  15. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.

  16. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved, the Promoter’s decision, acting reasonably, will be final.

  17. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). For the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death.

  18. The winner(s) will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed, and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.

  19. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.

  20. Privacy. Entrants’ personal information (PI) will be collected by the Promoter (or its agents) at the point of prize redemption solely for the purpose of verifying the entrant’s eligibility to enter and claim a prize (including verifying that the entrant is 18 years of age or older and a resident of an eligible State) and to enable the Promoter to administer the Promotion, including reporting to State and Territory gaming authorities to the extent required under applicable lottery legislation. PI may be disclosed to the agents, prize suppliers and relevant regulatory authorities for these purposes. Identification documents sighted for verification will not be copied or retained by the Promoter, except where required by law or by the relevant gaming authority. Any personal information collected will be stored securely and destroyed or de-identified when no longer required for the purposes described above, unless retention is required by law. If the PI requested is not provided, the entrant may not be able to claim a prize. By entering this Promotion, the entrant consents to the collection and use of their PI as described.     1. the entrant has created the entry themself;

    2. the entrant is entitled to reproduce and exploit all of the underlying works in the entry;

  12. Each entrant consents to the Promoter (and each of its assignees and licensees) doing or omitting to do anything which may infringe any and all moral rights of the entrant including to edit, alter and reproduce the entry, and that such consents have been obtained to the full extent permitted under the Copyright Act 1968 (Cth).

  13. As a condition of accepting the prize, each winner agrees to:

    1. if required by the Promoter, sign a statutory declaration regarding the originality of their entry; and

    2. irrevocably and unconditionally assign to the Promoter all of his/her right, title and interest (including without limitation all intellectual property rights such as present and future copyright) in and to the winning entry and to sign a document (in a form to be determined by the Promoter) to acknowledge this assignment to the Promoter.

Each entrant acknowledges and agrees that if their entry wins, the Promoter (any each of its assignees and licensees) have the right, in their absolute discretion, to edit, amend, copy, use, publish, broadcast and communicate to the public, the entry in any media including the internet, without any further consultation, reference, payment or any other compensation to the entrant.

  18. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

  19. Once any prize has left the Promoter’s/supplier’s premises, the Promoter and its agencies and companies associated with the promotion will not be responsible for any delay in delivery, loss or damage to the prize.

  20. Each winner will be notified by Instagram direct message within seven (7) business days of the judging and in order to receive the prize, the winner will be asked to provide proof of identity, Australian mobile number and email address. The Promoter may require a winner to verify their entry and provide proof of identity, including proof of age and proof of residency at the nominated prize delivery address. Proof considered suitable for verification is at the Promoter’s discretion.

  21. Prizes will be emailed by the Promoter directly to the winner to the email address provided through Instagram direct message within 28 days of the address being provided.

  22. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded. The judges’ decision is final and no correspondence will be entered into.

  23. The Promoter may verify the validity of entries, and in its sole discretion, disqualify all entries from, and prohibit further participation in this promotion by, any person who manipulates or tampers with or benefits from any manipulation of or tampering with the entry process or the operation of the promotion (including, but not limited to soliciting votes, disguising an IP address, using multiple email addresses or aliases to submit multiple entries for the same person, or other electronic account) or acts in violation of these conditions, acts in a dishonest or disruptive manner , acts with the intent to annoy, abuse, threaten or harass any other person, or acts in a way to jeopardise the fair operation of the promotion.. The Promoter’s decision in relation to all aspects of the promotion is final and no correspondence will be entered into.

  24. Prizes are not transferable or exchangeable and cannot be redeemed for cash. In the event for any reason a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.

If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, manipulation, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries.

  26. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

  27. In the event of a prize not being accepted or claimed, the judges will select an alternate winner with the entry judged to be the next best entry to receive that prize.

The PI of winners may be provided to third parties assisting in the conduct of the promotion, including prize suppliers and deliverers, and for publicity purposes surrounding the promotion.
